Democratic Lawmakers Demand Paxton Position
Texas House Democrats issued a formal request for Attorney General Ken Paxton to clarify his office's enforcement priorities on cannabis possession and distribution. The demand came after Paxton declined to answer questions about his stance during a public forum last week, according to statements released by the Democratic caucus.
Paxton's office hasn't responded. As of Monday afternoon, the inquiry remains unanswered.
Rogan's Political Warning on THC Policy
Podcast host Joe Rogan, a Texas resident since 2020, warned on his August 15 episode that strict THC enforcement could drive younger voters away from the Republican Party in Texas. Cannabis policy has become a litmus test for personal freedom among voters under 40, he argued.
"If they ban THC here, this state turns blue," Rogan said during the episode. "It's that simple."
Current Texas Cannabis Law
Texas law classifies possession of any amount of marijuana as a criminal offense under Texas Health and Safety Code § 481.121. Possession of two ounces or less is a Class B misdemeanor punishable by up to 180 days in jail and a $2,000 fine.
The state's Compassionate Use Program, established in 2015 and expanded in 2019 and 2021, permits low-THC cannabis for qualifying medical conditions. THC concentration is capped at 1 percent by weight.
Attorney General's Enforcement Record
Paxton's office has defended Texas's cannabis prohibition in multiple court challenges since 2023. In March 2025, the AG's office filed a brief opposing a Harris County district court ruling that found the state's possession statute unconstitutionally vague.
That case remains on appeal before the Texas Court of Criminal Appeals.
Legislative Context
The 89th Texas Legislature adjourned in May 2026 without advancing any cannabis decriminalization or legalization bills out of committee. House Bill 218, which would have reduced possession penalties to a civil fine, died in the Criminal Jurisprudence Committee.

Polling and Electoral Implications
A University of Texas/Texas Politics Project poll conducted in June 2026 found 68 percent of Texas voters support decriminalizing small amounts of marijuana. Support was highest among voters aged 18-29, at 81 percent.
The gap between public opinion and state policy on cannabis has widened to a point where it may influence turnout in competitive districts.
What Comes Next
Democratic legislators have set a September 1 deadline for Paxton to respond to their inquiry. If the Attorney General declines to answer, the caucus has indicated it may file a formal complaint with the State Bar of Texas alleging evasion of public accountability.
The next legislative session convenes in January 2027. Cannabis reform advocates are preparing to reintroduce decriminalization measures in both chambers.
